為什麼加拿大學簽申請會被拒簽？「移民傾向」成為了被拒簽統一使用的理由。這次來探究一下: 什麼是「移民傾向」？申請被拒真的是因為有「移民傾向」嗎？

什麼是「移民傾向」？

加拿大移民法案和條例從來沒有「移民傾向」的說法，更多是存在於美國的簽證和移民當中。

根據《美國移民和國籍法》第214(b)條規定，所有申請人在申請簽證時都會先被假設為有「移民傾向」，除非他 / 她能使簽證官相信其具有非移民資格（即臨時居民簽證）Act Section 214(b) — making you ineligible to receive a non-immigrant visa based on a presumption of being an intending immigrant or not meeting one of the other eligibility requirements for the visa category you applied for.

而《加拿大移民法》第22(2) 條規定，只要簽證官相信申請人會按時離開加拿大，未來成為永久居民的意向並不能成為臨時居民簽證申請拒籤的理由 A22(2) An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.

「雙重意向 Duel Intent」

這涉及到一個官方術語「雙重意向 Duel Intent」：同時呈現臨時居民和永久居民意向，在加拿大移民法中是合理合法的 Having two intents (one for temporary residence, and one for permanent residence) is legitimate.

因此，雖然簽證官不會以「移民傾向」為由而拒簽，但如果不相信申請人會按時離開加拿大，拒簽將是必然的結果。在各類簽證的拒簽信當中，最常見的拒簽理由：I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on the purpose of your visit.

「訪問目的 Purpose of Visit」

申請人有真實清楚的「訪問目的Purpose of Visit」且不會逾期逗留，是申請簽證最需要注意的地方。簽證官並不擔心申請人有所謂的「移民傾向」，而是擔心如果簽證獲批，申請人會將來有非法逾期滯留在加拿大的可能性。

「與原籍國的聯繫 Ties to the home country」

為了打消簽證官的質疑，申請人需要根據自身情況，盡可能提供不會逾期逗留加拿大的證明，體現各方面「與原籍國有很強的聯繫」。

明確提及此次出行結束後會返回原籍國繼續生活
來加拿大學習是真實意願
有房屋需要管理
有家庭成員需要照顧, etc.

簽證官的考量

在審理臨時居民的簽證申請時，簽證官會考慮以下幾點：

「在加拿大停留的時間 The length of time that the client will be spending in Canada」
「資金支持 Means of support」
「與母國的聯繫 Obligations and ties to the home country」
「訪問目的 & 補充說明 The purpose and the context of the stay」
「提交文件的可信度 The credibility of documents and information submitted」
「過往遵守加拿大移民法 / 移民條例的情況 Past compliance with requirements of the IRPA and the Immigration and Refugee Protection Regulations (IRPR) that are applicable to temporary residents (visitors, students and workers), as well as information available in biographic and biometric information sharing」
